Representation of OOO ISK Geleand’s Interests and Recovery of an EPC Contract’s Penalty of RUB 60 Million

ISK Geleand engaged the law firm’s lawyers to defend its interests in the case of a half-year delay in the delivery of works by OOO BKK Group of Companies under the EPC contract.

It was a difficult project because of the lack of documentary evidence that counter-obligations under the EPC contract had been properly complied with, as well as due to the high penalties to recover.

In considering the case in the court of appeal, the law firm’s lawyers proved the proper performance of the client’s obligations under the EPC contract and the validity of the RUB 60 million penalty recovery demand.

The court upheld the legal position formulated by the law firm’s lawyers and fully satisfied the claims. The project was supported by Osip Rumyantsev, the law firm’s Managing Partner.
